What Counts As A DUI In Minnesota?

For most drivers, a blood alcohol content (BAC) of 0.08% or higher is considered a DUI. Blood alcohol consumption limits are lower for commercial drivers at 0.04%.

If you are under 21, any detectable amount of alcohol can result in charges.

What Are The Four Degrees Of DWI Charges In Minnesota?

Minnesota separates DWI offenses into four degrees to reflect the seriousness of the circumstances surrounding the arrest. Understanding these distinctions helps you anticipate what the court may consider and what penalties may apply.

4th Degree DWI – Misdemeanor

This is the lowest level DWI charge and typically applies in a first-time offense with a blood alcohol content below .16%. Although it is the least severe, it still carries the possibility of jail time, fines and administrative license consequences.

3rd Degree DWI – Gross Misdemeanor

3rd degree charges may arise when one aggravating factor is present. Common examples include high test results or a recent DWI conviction or license revocation. An aggravating factor can increase the penalties and may lead to longer license revocation periods.

2nd Degree DWI – Gross Misdemeanor

A 2nd decree DWI charge applies when two aggravating factors are present. Because the law views multiple aggravating factors as a sign of heightened risk, the court may impose stricter conditions, including mandatory bail or alcohol monitoring.

1st Degree DWI – Felony

In Minnesota, a DWI is classified as a felony when the individual has three prior impaired driving incidents within a set period or has a prior felony-level DWI on record. Felony DWI carries the most severe penalties, including the possibility of a lengthy prison sentence and long-term license revocation.

How Does Aggravating Factors Work In A Minnesota DWI?

Aggravating factors increase the severity of a DWI charge and influence criminal penalties and administrative sanctions. Common factors include:

  • Measuring a blood alcohol content of .16% or higher
  • Having a child under the age of 16 in the vehicle
  • A prior license revocation or DWI conviction within the last 10 years

These issues can elevate a case to a higher degree and may affect a defendant’s eligibility for certain programs or reduced penalties.

Will You Get “Whiskey Plates” After A Minnesota DUI?

Minnesota may require special registration plates, commonly called “whiskey plates,” for a vehicle involved in a 2nd degree DWI or when the driver’s alcohol content is .16% or higher. Whiskey plates signal that the vehicle is subject to heightened monitoring and can be inconvenient for those who share the vehicle.

Some individuals can avoid whiskey plates by enrolling in the Ignition Interlock Program, which allows eligible drivers to regain limited driving privileges if they can demonstrate ongoing sobriety compliance.
